Terms of Use
These terms apply to the MindAction app and the mindaction.cactotech.com website, published by Cacto Tech (“we”). By installing or using MindAction, you agree to them. If you do not agree, please do not use the app.
What MindAction is, and is not
MindAction offers practical self-help tools inspired by cognitive behavioral therapy (CBT): behavioral activation, behavioral experiments and structured problem solving. It is a self-help tool, not a medical device. It does not diagnose, treat, cure or prevent any condition, it does not give medical or psychological advice, and using it does not create a therapist–client relationship.
MindAction supports therapy and does not replace therapy or professional care. Its content is general and may not suit your situation. We make no promise about any result.
Crisis and emergencies
MindAction is not an emergency or crisis service. If you are in crisis, in danger, or thinking about harming yourself or someone else, contact your local emergency services or a crisis line right away. For example, in the United States and Canada you can call or text 988, and in Brazil you can call 188 (CVV). If you are elsewhere, search for your country’s crisis line or go to the nearest emergency department.
Safe use of behavioral experiments
Behavioral experiments must never involve dangerous actions, self-harm, abusive exposure, stopping or changing medication, reckless confrontation or unsafe testing of trauma. Plan sensitive experiments with your therapist. MindAction cannot judge whether a plan is safe for you, and you are responsible for what you choose to do. You can pause or choose a different experiment at any time.
Licence to use the app
We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to install and use MindAction on devices you own or control, under these terms and the rules of the store you downloaded it from. The app is licensed, not sold. For iOS, Apple’s Standard Licence Agreement for Licensed Applications (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies to the extent these terms do not modify it.
You may not copy, modify, sell, rent or distribute the app, remove its notices, or reverse engineer it, except where the law does not allow us to restrict that. Open-source components in the app stay under their own licences.
Your entries
You own what you write. Because entries stay on your device, we do not receive them and do not need a licence to use them. You are responsible for the reports and backups you create and for whom you share them with. Back up what matters to you: if you delete data, uninstall the app, or lose both your PIN and recovery codes, we cannot get it back.
Ownership and intellectual property
The app, the website, the MindAction name and logo, the companions Pip and Olive, the artwork, the text and the software belong to Cacto Tech or its licensors and are protected by law. These terms give you no ownership of them. You may link to the website, and you may quote short passages with credit, but you may not present our material as your own or use our names, logos or companions in a way that suggests we endorse you.
Acceptable use
Use MindAction and the website lawfully and considerately. Do not try to break, overload or gain unauthorized access to the website or its hosting, do not scrape it in a way that harms its operation, and do not use the app to harm yourself or others.
Availability and updates
We may update, change or stop parts of the app or website. The core exercises are designed to work offline, but we do not promise that the app or website will always be available or free of errors. Some features, such as ads, purchases and diagnostics, need an internet connection.
Warranty disclaimer
To the extent the law allows, MindAction and the website are provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. This does not affect warranties that the law says cannot be excluded.
Limit of liability
To the extent the law allows, Cacto Tech is not liable for indirect, incidental or consequential losses, for lost data, or for decisions you make using the app. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, such as liability for fraud, for intentional misconduct, for death or personal injury caused by negligence where the law applies, or your rights under the mandatory consumer-protection laws where you live.
Third-party services and links
The app and website work with services run by others, such as the Apple App Store, Google Play and Google AdMob. Their own terms and policies apply to them, and we are not responsible for them.
Ending your use
You can stop using MindAction at any time by deleting your data and uninstalling the app; cancel any subscription in your store account. We may suspend or end access if you seriously break these terms. Sections that by their nature should continue, such as ownership, disclaimers and limits of liability, continue after that.
Your statutory rights and governing law
These terms do not reduce the mandatory consumer rights you have where you live, and they do not stop you from bringing a claim in the courts of the place where you live when the law gives you that right. Where the law of your place of residence is mandatory, it applies to you.
Changes to these terms
We may update these terms. The date at the top shows the latest version. If you keep using MindAction after an update, you accept the new terms; if you do not agree, stop using the app. Changes do not apply to a dispute that began before them.
